T&Cs for Students / Clients
These provisions govern your purchases of digital content (documents, videos, training), subscriptions and live classes (in-person and/or video) via the EducTime platform, published by MON CERVEAU IT (SASU, share capital 1 000,00 €, 833 197 288 R.C.S. Avignon, SIREN 833 197 288, VAT FR40833197288, registered office 230 CR 37 NORD, BAS ABRIAN NORD, 84100 ORANGE, France). Unless expressly stated otherwise on the offer, EducTime acts solely as a technical intermediary and hosting provider under French LCEN law; the seller is the Teacher who publishes the offer.
General provisions
Purpose — Marketplace. EducTime connects teachers with students/clients.
Unless it is an EducTime-owned offer, EducTime is not a party to the sales contract, which is concluded between the Student and the Teacher.
Features & availability. Offer pages state the essential characteristics (format, duration, prerequisites,
and live class schedule). The Teacher remains solely responsible for accuracy and performance of the service.
Delivery / Access.
- Digital content/training: access from your account upon payment. Unless stated otherwise on the offer page,
access to training is granted without time limit as long as the service and the account remain active
(see the Privacy Policy for account handling).
- Subscriptions: access for the subscribed period, with possible tacit renewal depending on the offer.
- Live classes: venue or video link provided after payment, on the indicated dates/times.
Conduct. Use must remain lawful and fair; any unauthorised sharing or redistribution of content is prohibited.
GDPR (reminder).
- Account data: retained for the duration of use, then 3 years after inactivity.
- Billing data: retained for 10 years (legal obligation).

Payment
Payment service provider. Payments are processed via a secure payment service (e.g., Stripe).
Accepted methods are shown at checkout. An order is final upon successful settlement.
Fees and commissions. EducTime service fees may be added to the price set by the Teacher;
all amounts are displayed prior to confirmation.
Promotions. Promo codes apply per the displayed conditions (eligibility, period, stacking).
Right of withdrawal
Consumers — French Consumer Code (L221-18 et seq.).

Digital content supplied without a tangible medium: no withdrawal right after execution starts
if you gave your express consent and waived your right (L221-28, 13°). Before execution, the period is 14 days.

Live classes on a specific date/period (leisure activities): excluded from the withdrawal right (L221-28, 12°).
The session’s cancellation policy applies (see the offer and the “Liability/Cancellation” section).

Subscriptions: 14-day withdrawal right, unless access started with your express consent and waiver.
Cancellation / Rescheduling (default if not otherwise stated).
- Student cancellation: free up to 48 hours before the session, otherwise fully due.
- Teacher cancellation: full refund or rescheduling offered.
Process. A standard withdrawal form is available in your account when required.
Liability
EducTime’s role. EducTime acts as a technical intermediary and hosting provider (LCEN):
no prior editorial control is exercised over Teachers’ content.
Teachers are solely responsible for legality, pedagogical suitability, intellectual property,
and performance of their services.
Limitation. If EducTime’s liability were engaged, it would be strictly limited to the amount of fees/commissions
collected by EducTime for the transaction concerned.
LCEN notice. Any manifestly unlawful content may be reported to support; EducTime will promptly remove it where appropriate (Art. 6 LCEN).
T&Cs for Teachers / Sellers
These provisions govern your sales of content, training, subscriptions and live classes via EducTime, published by MON CERVEAU IT (SASU, 833 197 288 R.C.S. Avignon, VAT FR40833197288, registered office 230 CR 37 NORD, BAS ABRIAN NORD, 84100 ORANGE, France). You act as the seller in the legal sense; you remain solely responsible for your content, invoicing and all applicable legal obligations.
General provisions
Status & compliance. You declare that you hold an appropriate legal status (sole trader, company, authorised association, etc.)
and comply with your tax, social, accounting and consumer law obligations (where the buyer is a consumer).
Content & rights. You warrant that you hold all necessary rights (copyright, neighbouring rights, software, trademarks)
to the content you publish, and that you will not infringe third-party rights (including visuals, music, fonts, databases).
Access & duration. You clearly indicate the access duration to content/training.
Unless otherwise stated on the offer page, access to training is without time limit, subject to service availability
and no contractual breach by the Student.
Cancellation policy (live classes). Set clear terms (deadlines/penalties/rescheduling). By default:
- Student cancellation free up to 48 hours prior; otherwise fully due.
- Your cancellation: full refund or rescheduling offered.
Prohibitions. Off-platform payments, commission circumvention, fake reviews, scraping, misuse of Students’ data.
Payment
Payouts. Payments flow through the payment service provider (e.g., Stripe), with possible temporary hold
(anti-fraud, chargebacks, disputes). Net payout occurs per provider terms and displayed timelines.
Prices. You freely set your VAT-inclusive prices and ensure clear display (all taxes/fees included for the Student).
EducTime commissions/fees. EducTime charges commissions and/or fees on each sale/subscription
(rates/amounts available in your dashboard before publishing). These remunerate infrastructure, matchmaking,
messaging, hosting and related services.
KYC/KYB. Complete the required identity/business checks (ID, bank details, articles, etc.).
Otherwise, funds may be held and/or the account suspended.
Invoicing
Seller invoicing. Unless a specific self-billing mandate is agreed, you issue your own invoices to clients
(legal mentions, VAT, numbering). You comply with applicable VAT rules (territoriality, exemptions, OSS/IOSS where relevant).
Self-billing mandate (option). You may authorise EducTime to issue invoices in your name and on your behalf
under a separate mandate; you remain solely responsible for substance (VAT, nature of the operation, compliance).
Record retention. Accounting records relating to sales must be kept for 10 years (French Commercial Code L123-22).
You keep your duplicates and supporting documents.
Liability
Risk transfer. You are solely responsible for legality, quality, accuracy and pedagogical suitability of your offers,
as well as compliance with intellectual property rights.
Indemnification. You warrant and hold EducTime harmless from any third-party claim arising from your content
or services (costs, awards, fees).
EducTime’s role. EducTime provides infrastructure and acts as hosting provider (LCEN):
no prior editorial duty; prompt removal of manifestly unlawful content when duly reported.
Limitation. If EducTime’s liability were engaged, it would be strictly limited to the amount of commissions
collected by EducTime for the transaction at issue.
